Trust & Company Service Providers
Regulation & Compliance: Trust and Company Service Providers
It is important to understand that Trust and Company Service Providers are required to be regulated by HMRC or, if these services form part of their wider service provision, another approved regulator.
Under the current money-laundering regulations, a trust or company service provider is any company or sole practitioner whose business is to:
- Form companies or other legal persons
- Provide a:
– Business address
– Registered office
– Correspondence address
– Administrative address for a company, partnership, other legal person or arrangement
- Act or arrange for someone else to act as:
– Partner – or a similar position – for other legal persons
– Director or secretary of a company
– Nominee shareholder for another person (unless the other person is a company listed on a regulated market which is subject to acceptable disclosure requirements)
– Trustee of an express trust or similar legal arrangement
The extent of regulation and compliance needed will depend on the type of services provided. We work with businesses that are only required to comply with the MLR 2017, alongside more complex business structures that have weightier regulatory obligations.
Trust and Company Service Provider services include:
1. Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF) compliance
2. GDPR and Data Protection compliance
3. Complaint investigations, management and handling
4. Regulatory investigations
5. Bribery Act 2010 compliance
6. Treating Customers Fairly compliance
7. Employment Regulations compliance
